KolWavy Radio respects the intellectual-property rights of others and expects everyone on our platform to do the same. This policy explains how copyright works on KolWavy Radio, your licensing responsibilities, and how to submit copyright takedown notices and counter-notices.

1.Licensing is the station owner's responsibility

KolWavy Radio is a technology platform, not a music licensor or broadcaster. We do not grant, supply, or arrange any music licenses. Every station owner is solely responsible for obtaining and maintaining all rights and licenses required to broadcast their content — including sound-recording, musical-composition, performance, and any statutory or blanket licenses required by rights holders and collecting societies in each territory where the station is available. Operating a station without the required licenses is a violation of our Terms and Acceptable Use Policy.

2.Takedown notices (DMCA and equivalents)

If you believe content on the platform infringes your copyright, you may send us a written notice. To be effective, your notice should include:

  • Your physical or electronic signature (or that of the authorized agent).
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material claimed to be infringing and information reasonably sufficient to locate it (such as the station name, URL, and a description).
  • Your contact information (name, address, telephone number, and email).
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

Send notices to our designated copyright agent at copyright@kolwavy.com. Submitting false or misleading claims may expose you to liability.

3.What we do with a valid notice

Upon receiving a valid notice, we may remove or disable access to the allegedly infringing material and will make a reasonable effort to notify the affected station owner. We may take the related stream or content offline while the matter is resolved.

4.Counter-notices

If you are a station owner and believe your content was removed by mistake or misidentification, you may submit a counter-notice including:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement consenting to the jurisdiction of the appropriate courts and to accept service of process from the complaining party.

Send counter-notices to copyright@kolwavy.com. We may restore the material as permitted by applicable law if the original complainant does not pursue further legal action.

5.Repeat-infringer policy

We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of station owners or users who are repeat infringers. We may also take action against accounts that we determine are engaged in infringement even absent repeat notices.

6.Trademark and other IP concerns

For trademark or other intellectual-property concerns that are not copyright, contact legal@kolwavy.com with details of your claim and the material at issue.
