Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes conduct and content that are prohibited on the KolWavy Radio platform. It applies to every station owner, staff member, and anyone who broadcasts or interacts through the Service. It is incorporated into our Terms of Service. We may update it as needed to keep the platform safe and lawful.

1.Your responsibility

You are responsible for everything broadcast, uploaded, or transmitted through your Station — including content from your staff, your automated playlists, your AI Resident DJ, and your listeners (such as chat messages, song requests, and shoutouts). You must moderate your Station and ensure it complies with this AUP, our Terms, and all applicable laws in every territory where your Station is available.

2.Content licensing is mandatory

You must hold all rights and licenses required to broadcast your content. KolWavy Radio does not provide music licensing. Before you stream music or other third-party material, you must obtain the necessary sound-recording, composition, performance, and any statutory or blanket licenses required by the rights holders and collecting societies in your operating territories. Broadcasting unlicensed or infringing material is a violation of this AUP. See our Copyright & DMCA policy for more.

3.Prohibited content

You may not upload, broadcast, transmit, or make available content that:

  • Infringes any copyright, trademark, patent, trade secret, publicity, privacy, or other right.
  • Is unlawful, defamatory, fraudulent, or deceptive.
  • Is hateful or incites violence or discrimination based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any other protected characteristic.
  • Sexually exploits or endangers minors in any way. This is reported to authorities and results in immediate termination.
  • Is obscene, or is adult content broadcast without appropriate age-gating and legal compliance.
  • Harasses, threatens, bullies, or stalks any person.
  • Promotes terrorism, violent extremism, or serious harm.
  • Contains malware, or facilitates phishing, scams, or other harmful activity.
  • Discloses another person's private or personal information without authorization ("doxxing").

4.Prohibited conduct

You may not, and may not permit others to:

  • Use the Service to violate any law or regulation, or to infringe others' rights.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems and networks.
  • Interfere with or disrupt the Service, including denial-of-service attacks, flooding, or excessive load.
  • Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures.
  • Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
  • Scrape, crawl, or harvest data from the Service without permission.
  • Resell, sublicense, or provide the Service to third parties except as expressly permitted (note: operating white-label stations for your own audience is permitted).
  • Misrepresent your identity, your affiliation, or your relationship with KolWavy Radio.
  • Circumvent usage limits, billing, or access controls.

5.AI features

When you enable AI features (such as the AI Resident DJ), you must configure and moderate them responsibly. You may not use AI features to generate content that violates this AUP, to impersonate real individuals in a deceptive or harmful way, or to produce illegal, hateful, or infringing output. You remain responsible for all AI Output broadcast on your Station.

6.Listener interactions

Features like live chat, song requests, and shoutouts let your listeners contribute content. You must provide appropriate moderation to keep these interactions compliant with this AUP. We provide moderation tools; using them effectively is your responsibility.

7.Reporting violations

If you become aware of content or conduct on the platform that violates this AUP, report it to abuse@kolwavy.com. For copyright concerns, follow the process in our Copyright & DMCA policy.

8.Enforcement

We may investigate suspected violations and take any action we consider appropriate, including removing content, taking a Station offline, throttling, suspending, or terminating accounts, and reporting to law enforcement. Where practical and lawful, we will provide notice, but we may act immediately to address serious or ongoing harm. We are not obligated to monitor content but may do so.
